1. Acceptance of Terms

By accessing or using Movent.AI ("the Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use the Service.

We may update these terms from time to time. Your continued use of the Service after changes constitutes acceptance of the updated terms.

2. Service Description

Movent.AI is a personalized activity recommendation platform that helps users discover leisure activities based on their preferences, location, and availability.

The Service includes:

Personalized activity suggestions
Event and place recommendations
Group activity planning features
User preference management
AI-powered activity notifications

Note: Movent.AI is under continuous development. Features may change, and the service may have occasional interruptions.

What Movent is — and is not

Movent is an information and discovery service. We publish information about places, events and offers, and we let users organise their own meetups.

Movent is not:

an organiser, operator, promoter or host of any activity, event or venue;
a party to any booking, purchase, membership or agreement you enter into with a venue, an organiser, or another user;
an agent or broker acting for you or for any venue;
a provider of medical, fitness, safety or legal advice.

Any agreement about an activity is between you and the venue, the organiser, or the other people involved. Movent is not part of it.

3. User Accounts

To use certain features, you must create an account. You agree to:

Provide accurate and complete information
Keep your account credentials secure
Notify us immediately of any unauthorized access
Be responsible for all activities under your account

You must be at least 16 years old to create an account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

Use the Service for any illegal or unauthorized purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Upload malicious code or content
Impersonate others or provide false information
Harass, abuse, or harm other users
Use automated systems to access the Service without permission
Collect user data without consent

5. Intellectual Property

The Service — the software, design, brand and the editorial content we write ourselves — is owned by the provider named in section 16 and is protected by copyright, trademark, and other intellectual property laws.

Venue and event material shown in the Service (listings, photos, opening hours, prices, offers) comes from venues, organisers and public sources, and remains the property of its respective owners. See the Legal Notice for how to have such material corrected or removed.

You may not:

Copy, modify, or distribute our content without permission
Use our trademarks or logos without authorization
Reverse engineer or attempt to extract source code

6. User Content

You retain ownership of any content you submit to the Service (preferences, feedback, messages, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce and display that content for operating and promoting the Service.

You are responsible for ensuring your content does not violate any laws or third-party rights, and you will hold us harmless against third-party claims arising from content you submit.

Reporting illegal content

If you believe content on Movent is illegal, write to admin@movent.ai and tell us where it is and why. We review every report we receive and tell you what we decided.

We act on reports rather than screening everything in advance: a service like ours is not required to search the platform for illegal content on its own initiative, and we do not undertake to do so.

7. Activity Disclaimer & User Responsibility

Information Accuracy

Activity recommendations, event details, venue information, and place data are provided for informational purposes only. We do not guarantee the accuracy, completeness, timeliness, or reliability of any information displayed. Information may be outdated, incorrect, or no longer valid at the time you access it.

User Verification Required

You must independently verify all details before participating in any activity, including but not limited to: opening hours, availability, pricing, location accuracy, safety conditions, accessibility, and current operation status. Always contact venues, event organizers, or official sources directly to confirm information.

Assumption of Risk

By using our recommendations and participating in any suggested activity, you acknowledge that you do so entirely at your own risk. You are solely responsible for assessing whether an activity is appropriate for your physical condition, skill level, health status, and personal circumstances.

Physical Activities Warning

Some recommended activities may involve physical exertion, outdoor environments, or inherent risks of injury. You should consult a medical professional before engaging in physical activities if you have any health concerns, medical conditions, or physical limitations.

No Liability for Outcomes

We do not organise, supervise or inspect activities, venues or events, and we do not assume a duty of care for what happens during them. We therefore do not accept responsibility for injury, accident, illness, loss or damage arising from an activity you choose to take part in.

Liability for personal injury caused by us, and for damage we cause intentionally or by gross negligence, is not excluded and remains unaffected.

Third-Party Venues & Events

We have no control over third-party venues, events, or service providers. Their policies, safety standards, quality of service, and availability are entirely beyond our control. We do not endorse, guarantee, or take responsibility for any third-party services or experiences.

Hangouts & User Meetups

The Service lets users organize and join meetups ("hangouts"). Hangouts are organized by users, not by Movent.AI. We do not vet, screen, or supervise participants, venues, or activities, and we are not a party to any meetup. Participation in a hangout is entirely at your own risk: you alone decide whom you meet, where you go, and what you do. To the extent permitted by applicable law, Movent.AI is not liable for the conduct of any participant, whether online or in person. We recommend meeting in public places, telling someone you trust where you are going, and leaving any situation in which you feel unsafe.

We do not carry out identity checks, background checks or criminal record checks on any user. A profile name or photo is not verified by us.
We do not check whether a venue or activity is safe, supervised or insured.
No Movent representative is present at any hangout.
If you bring a minor, you are solely responsible for them.
Tell us about unsafe behaviour at admin@movent.ai — we look at every report and can remove users or hangouts. We cannot supervise meetups as they happen.

Automated & AI-Generated Content

Parts of Movent are automated. Recommendations are produced by algorithms and AI models, chat replies are AI-generated, and some images are AI-generated and labelled as such. Automated output can be wrong, out of date, or unsuitable for you. It is a suggestion, never advice, and never a substitute for checking with the venue or a qualified professional.

Summary: Our recommendations are suggestions only. You are responsible for your own decisions and safety. Always verify information independently and assess risks before participating in any activity.

8. General Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not guarantee that:

The Service will be uninterrupted or error-free
Activity recommendations will meet your expectations
The Service will be available at all times

We are not liable for loss of data, content or plans caused by interruption, account deletion, or discontinuation of a feature. Keep your own copy of anything you need.

We are not liable for failures caused by events outside our control, including outages at hosting, network or third-party service providers, or acts of authority.

9. Limitation of Liability

To the maximum extent permitted by law, Movent.AI and its founders, employees, and affiliates shall not be liable for:

Any indirect, incidental, special, or consequential damages
Loss of profits, data, or business opportunities
Personal injury or property damage resulting from activities recommended by the Service
Any third-party content or services

Our total liability for any claims arising from or relating to the Service shall not exceed €100, or the amount you paid us in the preceding 12 months, whichever is higher.

Limits of this clause. Liability for personal injury, and for damage caused intentionally or by gross negligence, remains unaffected. Mandatory consumer protection rights under Austrian law are not limited by this clause.

10. Indemnification

You agree to indemnify and hold harmless Movent.AI and its founders, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights

11. Termination

By You: You may delete your account at any time through the platform's profile settings. Your data will be retained for 30 days (recovery period), then permanently deleted.

By Us: We may suspend or terminate your account if you violate these Terms or engage in behavior that harms other users or the Service. We will notify you of the reason for termination where possible.

12. Changes to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable for any modification, suspension, or discontinuation of the Service.

13. Third-Party Links

The Service may contain links to third-party websites or services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria.

If you are a consumer resident in the EU, you also have the right to bring proceedings in the courts of your country of residence.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
